The Terms & Conditions below set out the terms for using our Website. www.justplattersbyrose.com.au (our "Site" or "Website")

and govern your access to and use of our products and services.

Please read the terms carefully before using this Site.

 

The use of our services constitutes the acceptance of these

Terms & Conditions.

General

This Website, www.justplattersbyrose.com.au, is owned and operated by

Just Platters by Rose ("we", "us", "our"). ​

We are a registered Australian business operating under the

ABN: 17 142 387 074.

Non-Liability, Consumption for Risk & Food Safety

To ensure the best quality and freshness of food, all food items should be consumed within 2 hours after delivery/ after table setup completion.

Consumption of food items exceeding 2 hours once delivered/ after

table setup completion (and not refrigerated) becomes your own risk.

Leftover food(s) can be refrigerated and eaten within 48 hours.

Leave the platter box lid on once in the fridge, or store the remaining

food items in an air-tight container. Please note that crackers may

lose their crispiness and freshness.

Due to the nature of our food, please keep platters out of

direct sunlight, preferably in a shaded area.

After delivery/ table setup completion, Just Platters by Rose will not be

liable for any resulting illness for failing to take health

 and hygiene measures in handling and consuming our products.

We do not accept any liability for any loss, damage

or injury that may occur directly or indirectly related to the presentation

and location of the platters, if otherwise, by our recommendations.

Please note that our produce is locally sourced, fresh,

and seasonal; therefore, due to availability, we reserve the right

to substitute items when ingredients may not be available due to seasonality or availability.

All substitutions are of equivalent quality and value.

Allergy Information

Just Platters by Rose prides itself on using fresh and quality

ingredients for our valued customers. It is your responsibility to inform

us of any food allergies or intolerances in advance.

Failure to do so will not hold us liable for any food allergy reaction

or intolerance.

Due to the nature of our products, all our platter boxes and table setups may contain the following:

* Peanuts and tree Nuts (e.g. cashews, almonds)

* Eggs and Milk

* Fish and Crustaceans (e.g. prawns, lobster)

* Sesame Seeds and Herbs

* Soybeans

* Wheat (gluten) and Lupin.

Please let us know before placing your order if there are any allergies

or intolerances. We will get back to you as soon as possible

to discuss if your order can still be fulfilled.

​Please note that our platter boxes/ table setups are not prepared in an

allergen-free environment; therefore, we cannot guarantee that our

products are allergen-free.

Anyone with a food allergy should avoid or take extra caution from

consuming our products.

Placing Platter Box Orders/Payment

To confirm your platter box order, full payment is required.

All platter box orders must be made via our Website or phone. Unfortunately,

we do not have an 'on-the-day' orders option.

We require at least five (5) days' notice so we can arrange for fresh produce

to be picked up or delivered from our local suppliers.

We recommend placing orders for events and custom platters at

least two weeks in advance to ensure all produce and items are available.

By placing an order on our Site, you are making an offer to enter

into an agreement to purchase the product(s) in that order.

Orders will be deemed received by us at the time of your order,

and you will receive an order confirmation via your nominated

email address.

You are responsible for ensuring that the correct email address and

contact details are entered correctly with your order.

Please note your requested date and time will be confirmed via email.

If we are unable to fulfil your requested date and time, we will offer a suitable alternative date and time. If the alternative date and time are

unsuitable, we will contact you further to discuss.

​​All platter boxes must be paid in full via our online store/phone to

secure your booking and delivery date.

Please note that platter boxes may differ from photographs on our

Website and Social Media pages.

We try to make all platters identical; however, slight differences

may be present as each platter is created fresh and customised to

order and subject to produce/supplier availability.

Contents inside platter boxes may vary depending on the size of the box.

​For example, a small box will not be able to fit as many delights as a

medium or large box; however, it will be jam-packed with the same

various food items but in a lesser volume.

Placing Table Setup Orders​

All our table setups are customised, table setup orders must be

confirmed via phone or email. After all details are confirmed, an invoice

will be sent to your nominated email address.

To confirm the booking date and time, we require at least 50% of the invoice payment to secure the table setup booking date and time.

This payment must be made within 48 hours of receiving the invoice.

If this payment is not made within the time frame, Just Platters by Rose

reserves the right to cancel the table set-up order.

 

The remaining 50% must be paid at least five (5) days before the

table setup date. If the payment is not made in time, Just Platters by Rose

reserves the right to cancel your order, and no refunds will be issued

for the other payment(s) paid.

Alternatively, you are more than welcome to pay in full.

Table Setup payments can be made via direct deposit or credit/debit card.

Please note there is a 2.7% card fee.

We require a $100.00 bond for all Table Setup orders for the boards,

Bain Maries, crockery, and all other items used for the table setups.

The $100.00 bond will be refunded the day after pick-up

(the next day of pick-up day) of the boards, crockery, etc.

 

The bond will be refunded if no board, crockery, etc., is missing,

damaged or broken. If any item(s) are missing, damaged or broken,

the bond will not be refunded, and an additional fee will be charged

for any item(s) valued more than the bond amount.

The additional fee will be charged upon collection via a credit/debit card,

and a 2.7% card fee will be charged. 

A cleaning fee of $100.00 will be charged for all boards, Bain Maries,

crockery, etc., that have not been cleared from food and cleaned upon collection.

Please have all wooden boards cleared from food and wiped down

with a damped cloth or wiped, then dried.

 

Please do not place any wooden boards in a dishwasher or handwash

as this will damage the wooden board.

Please have all Bain Marie’s emptied from water, cleaned, and dried.

These can be placed in a dishwasher or hand-washed, and all crockery,

utensils, etc. washed and dried.

Cancellation for Platter Box Orders

​We understand that, at times, plans do not go ahead, and

should you wish to cancel your platter box order, please cancel at

least five (5) days prior to the delivery date; otherwise, the paid amount

will be forfeited.

Platter Box cancellations before five (5) days of delivery date will

be offered a credit voucher to use on any future platter box order(s) or to go towards a table setup order in the future. This is valid for two (2) years.

Cancellation notice for Platter Box order(s) must be placed via email to sales@justplattersbyrose.com.au

Platter Box orders cannot be cancelled on the day of delivery.

If you require the order to be cancelled on delivery day, a refund

will not be offered, and you will be charged a cancellation fee of

the same price as your platter box order.

If you need to change your delivery address, please notify us

at least three (3) days prior to your requested delivery date.

Additional delivery charges may be applied.

Refunds will not be offered if you are not satisfied with the

platter box order(s).

Cancellation for Table Setup Order

If you wish to cancel your table setup order, cancellation must be

at least fourteen (14) days before the setup date; otherwise,

the paid amount will be forfeited.

For all Table Setup cancellations made at least fourteen (14) days

before the setup date, a credit voucher will be offered with the amount

paid up to the cancellation date. We do not offer a refund on cancellations.

Table Setup Orders cannot be cancelled on the setup date day.

If you require the order to be cancelled on setup day, a refund will

not be offered, and you will be charged a cancellation fee of

40% of your order.

If you need to change your setup address or date, please notify us at

least ten (10) days prior to the setup date.

An additional delivery/collection fee may apply based on the new address.

If we cannot change your new date or keep your original date

due to unforeseen circumstances (e.g. Covid-19 Government lockdowns,

or other related Covid-19 restrictions or Force Majeure).

A credit voucher will be offered with a three (3) year expiration date.

All payments made up to the cancellation date will go

towards the credit voucher.

All changes or cancellations must be emailed to

sales@justplattersbyrose.com.au​.

No refund will be offered if you are unsatisfied with the table setup.

Hours of Operation

We operate six (6) days a week. (We are closed on Mondays).

Our Platter box delivery hours are between 9am-7pm.

Delivery outside these hours will incur a 10% surcharge of the

total amount of the order.

Deliveries are of a two-hour delivery slot, for example, delivery

between 9am-11am.

​A surcharge exemption for delivery outside the delivery hours

occurs for the following delivery days:

​*Australia Day

*Valentine's Day

*Easter Saturday

*Easter Sunday

*Easter Monday

*Mother's & Father's Day

*Christmas & Boxing Day

*New Year's Eve & New Year's Day

Delivery For Platter Box Orders

We deliver Sydney-wide, Wollongong and Illawarra region, Southern Highlands,

lower Blue Mountains region, and lower Central Coast of New South Wales.

 If you are uncertain or if your suburb is not shown on the

delivery section, please let us know, and we will confirm if we

deliver to that selected suburb/area.

For all Platter Box Order(s), the delivery fee is payable in addition

to the cost of your order and will be calculated at the checkout on the Website.

Free delivery is offered for all platter box orders over $500.00.

Please note that due to the nature of our products, we do not

recommend your order be left unattended.

In the case that no one is at the premises to receive the order

on the requested date and time slot of delivery, we will call you to

inform you of the situation, and if you would like the order to be left,

we will try to leave it in a shaded and secure spot.

 A photo will be texted to you of where we left the order.

​A fee will incur (at our discretion) if you choose a different time or

date due to no one being at the premises.

If we are supplied with an incorrect or incomplete address, the order will be returned to Just Platters by Rose, and a re-delivery fee will be incurred

at the cost of our discretion.

Just Platters by Rose will do its best to deliver your order to your

specified date and time slot selected when the order was placed; however,

in an event that is out of our control, please allow more time.

If this is the case, you will be notified immediately. 

A refund will not be offered due to the delay in delivery time, which is out of our control.

 

Event Delivery Days (E.g., Christmas Day)

Please note all times for events (e.g. Christmas, Easter, Mother's Day etc),

we will provide an approximate two-hour time slot between 7:30am-12pm

based on your LGA location.

In the event we are unable to deliver the order within the time slot

provided due to unforeseen circumstances that occur during delivery,

e.g. traffic conditions, roadblocks, police blocks, natural disasters,

and Force Majeure events, we will notify you immediately and deliver

the order, if it is safe to do so. 

In the case that we are unable to deliver the order on the same day, a

full refund will be offered.

Delivery For Table Setups

Deliveries for Table Setup hours are from 8am-9pm.

A fee will apply for setups before or after these hours.

​We service Sydney-wide, Wollongong and Illawarra region, Southern

Highlands, lower Blue Mountains areas, and lower Central Coast areas.

​The Delivery fee is included in the quote. If the suburb/location of the

table setup needs to be changed after the deposit or full payment is made,

an extra delivery fee (at our discretion) may be incurred.

​Just Platters by Rose will do its best to fulfil our arrival time for your

table setup at the specified time on the email confirmation and invoice.

In the event we are unable to arrive within the time frame given due to

unforeseen circumstances, we will notify you immediately.

In the case that we are delayed majorly (more than two (2) hours), we will

offer a partial refund at our discretion. In the event we cannot arrive at

all due to unforeseen circumstances, a refund will be issued.

​Limitation of Liability

To the fullest extent permissible by law, Just Platters by Rose will not

under any circumstances be liable to you for any direct, indirect, incidental, punitive, or consequential losses or damages to any client, supplier,

person, or property arising from the use of our Website, services, or products.

 

In particular, we will not be liable to you for indirect and consequential

loss or damage, including, without limitation, loss of profits, sales or

revenue, commercial or economic loss of any kind, loss of goodwill or

reputation, or loss or corruption of data, in contract, tort, under any

statute or otherwise (including negligence) arising from or associated with our Website or our products.

You acknowledge that the content on our Website is provided for general information only and is not intended to be advice that you should rely on.

We will, in good faith, make reasonable efforts to provide you

with accurate and up-to-date information on our Website.

There may be instances where inaccuracies and disparities occur.

Just Platters by Rose will not be liable for any errors or differences in our product details, images, prices, or promotional information on our Website.

​The limitation of liability set out above will not apply to any claim that is the consequence of deception, dishonesty, wilful falsification, or deliberate concealment by or on behalf of Just Platters by Rose.

 

Force Majeure Events

Just Platters by Rose will not be liable for failures to perform its obligations

arising from any cause beyond its reasonable control, including, without

limitation, accidents, fires, floods, storms, machinery malfunctions, and breakdowns, strikes, supply shortages, lockouts, epidemics, pandemics, government restrictions, wars, terrorist acts, or riots.

Website Viruses

​Our Website is constantly monitored for viruses or bugs; however,

we cannot guarantee that our Site is secure or free from viruses, bugs, errors, defects, or omissions.

​Just Platters by Rose is not responsible for any damages or losses

(direct, indirect, incidental or consequential) arising out of the

use of this Website.

You are responsible for instigating your own virus protection software.

Third-Party Websites

​Our Website, at times, contains links to other sites and resources by third

parties, which is provided for your information only.

​Our inclusion of those links to a third-party website does not imply any endorsement of the material on our Website or, unless disclosed otherwise, any sponsorship, affiliation or association with its owner.

Linking to Our Site

​You may link our Website or mention our brand name, provided you do so in a manner that is reasonable, legal and does not damage our reputation

or take advantage of it.

​Just Platters by Rose reserves the right to withdraw linking permission

without notice. If you wish to make use of our content on our Website,

Privacy Policy

We take our customer's privacy seriously, and we only collect and use your

personal information for the delivery of your orders, to update you on

your order, including delivery and customer support.

We do not sell, share, or trade a customer's personal information collected

online with third parties. Personal information collected online will only be

for internal use only.

​In exceptional circumstances, Just Platters by Rose may be required to

disclose personal information, such as when there are grounds to believe that the disclosure is necessary to prevent a threat to life or health or for

law enforcement purposes.

​Our Privacy Statement fully complies with the Privacy Act 1988.

​You also confirm you have read and agreed to our Privacy Policy,

which forms part of these Terms.
